**OFFICIAL RULES**
NO PURCHASE NECESSARY TO ENTER OR WIN. Void where
prohibited or restricted by law. Drawing open to legal Oahu, Hawaii residents 18 years old and older at the time of entry. Drawing not open to
employees and their immediate families of Sponsors. Winners must prove
eligibility. To enter, complete the registration form in full and submit via
online web form or drop into official Sun Splash Tans entry box or by
bringing directly to Sun Splash Tans at 625 Kapahulu Ave, Honolulu, HI
96815. Entries received prior to or after the Promotional Period shall
be considered void. Use of false or misleading personal information by
an entrant will be grounds for disqualification. Determination of
information to be false or misleading is at the sole discretion of Sun
Splash Tans or Sponsors.
Entrants must complete all required data. Incomplete
or inaccurate entries are void. Limit one entry per person per calendar year.
Collection and use of personally identifiable information will be in
accordance with Sun Splash Tans Privacy Policy. All entries must be
received by 3 p.m. (HST) on the last day of any given month in which a
drawing is done. By submitting you understand and agree to being
contacted for the promotion of Sun Splash Tans goods and services.
Odds of winning will depend on the total number of
eligible entries. One (1) winner will be selected at random on the first
day of each month for all months in which the Promotional Period is
active and such winner shall receive a 3-month Level 1 Tanning
package, valued at approximately $180. A minimum of 100 entries is
required for a drawing to occur. If fewer than the minimum entries are received
in one month then no drawing will me made for that month and the entries
may be carried forward into future months until the minimum is reached. Potential Prize Winners will be
notified within 10 calendar days from the date of drawing. If a
Potential Prize Winner cannot be reached during such ten-day period,
Potential Prize Winner will be disqualified and another name drawn at
random from among all of those remaining. Potential Prize Winners must
prove eligibility, including verification of age and residence within 5
days of notification. In order for Potential Prize Winners to be deemed
the Prize Winners, he or she will be required to sign an affidavit (i)
releasing Sun Splash Tans from any and all liability, claims, demands
and causes of action for personal injury and/or damage, theft, or loss
suffered in connection with this Drawing or the use or acceptance of the
prizes or any portion thereof to be eligible for the prizes; and (ii)
where permitted by law, granting Sun Splash Tans the right to use his or
her name, voice and likeness for advertising and publicity purposes
without additional compensation. Upon receipt of the Prize, the Prize
Winner is required to comply with any and all applicable federal, state
and local laws, rules and regulations including, but not limited to
licensing and insurance requirements. The value of each Prize may be
taxable as income and Prize Winner is solely responsible for all matters
relating to the Prize, including, but not limited to all applicable
federal, state and local taxes that become due with respect to the Prize
By entering, participants acknowledge compliance with
these Official Rules including all eligibility requirements. Sun Splash
Tans and its respective parent, subsidiary and affiliated companies,
licensees, advertising and promotional agencies, the independent judging
organization, printing agents (collectively, the "Sponsors") are not
responsible for entries that are illegible, incomplete, lost, delayed,
mutilated and misdirected, or for typographical errors in the rules or
any problems or technical malfunctions, human error, lost/delayed data
transmission, omission, interruption, deletion, defect, line failures of
any telephone network, computer on-line systems, servers or providers,
computer equipment, software, failure of entrants on account of
technical problems or traffic congestion on the internet or at any web
site or any combination thereof, including injury or damage to
participants resulting from participating in this Drawing or use of any
Sun Splash Tans equipment. If for any reason the Drawing is not capable
of execution as planned, including tampering, unauthorized intervention,
fraud, technical failures, or any other cause beyond the control of the
Sponsors which corrupt or affect the administration, security, fairness,
integrity or proper conduct of this Drawing, Sponsors reserve the right
at their sole discretion to cancel, terminate, modify or suspend the
Drawing or any portion thereof. Should the Drawing be terminated or
cancelled prior to the stated expiration date, Sponsors may or may not
give notice at their sole discretion and any entries received prior to
the termination or cancellation will be included. Entries that have been
tampered with or altered will be deemed void. In the event of a dispute
over who submitted the winning entry, the holder of the winning email
address will be declared the winner. The use of any system or agent to
submit entries in connection with this Drawing is prohibited and will
result in disqualification.
All prizes are non-transferable and have no cash
equivalent. Prizes can not be returned for cash. Substitution of prizes
by winners is prohibited. Sponsors reserve the right to substitute a
prize with another prize of equal or greater value. In the event a Prize
Winner chooses not to accept his/her prize, does not comply with these
Official Rules, or Sponsors are unable to contact such winner or
notification of prize is returned as undeliverable, the prize will be
forfeited in its entirety and awarded to an alternate winner as
described above. Winners will be notified via the email address provided
and must be claimed within two weeks of notification or the prize will
be forfeited. All entries become the property of Sponsors and will
not be acknowledged or returned except as herein described. Entry into
this Drawing constitutes winner's agreement to sign any and all legal
documents which Sponsors may require (including but not limited to a W9
tax form All interpretations of the rules and decisions by Sun Splash
Tans are final. Sun Splash Tans reserves the right at its sole
discretion to disqualify any individual it finds to be tampering with
the entry process or the operation of the Drawing or any other party
associated therewith.
